Security and Privacy

All information is confidential. No personal information will be shared with other parties we use the industry standard, highest level encryption technology currently available to protect your data during transmission and after receipt, but, whilst no security system can be completely foolproof the risks are extremely low.

Payment Terms

Full payment is required before goods will be dispatched. We accept Bankers Drafts, Bank Transfer (special instructions as to labelling apply), Cheques (cleared in our account before dispatch of goods or services), Most Major Credit Cards, which incur a 2.5% service charge.

Failure to pay any amount due under the Contract on the due date will result in DirectSeeds.com charging a penalty of £25 per day until the account is settled. The Client shall notify DirectSeeds.com of any disputed amounts within 5 working days of the date of the invoice or request for payment

Liability

Liability on behalf of DirectSeeds.com of any description, excluding death and personal injury, is limited to the price of goods supplied.

Deliveries

Delivery Dates and Times

Delivery dates and times provided as an indication only and cannot be guaranteed.

DirectSeeds.com reserves the right to re-schedule a delivery if full payment – or notice of full payment – is not received by 12PM on the day before the chosen delivery date.

Delayed Deliveries

Delays are uncommon but they may occur due to circumstances beyond our control such as post office strikes or traffic conditions and issues beyond the control of DirectSeeds.com such as delayed 3dr party deliveries (i.e. The Couriers). In such cases, the terms below will apply

If a DirectSeeds.com delivery is delayed, DirectSeeds.com will attempt delivery at the next available delivery slot (usually the following day). The Client may contact DirectSeeds.com and re-schedule the delivery free of charge.

If a 3rd party delivery (i.e. by The Courier) is delayed, The Courier will attempt delivery on the following working day. The courier will re-attempt delivery for up to 3 working days.

Refunds

Delayed deliveries do not constitute reason for a refund. Refunds will not be issued for orders where the goods are delivered after the chosen date or time.

Delivery of Faulty or Unsatisfactory Goods

If The Client is unhappy with the quality of the goods delivered, The Client may be eligible to a free replacement, but may incur a re-delivery charge. DirectSeeds.com will not replace goods unless given written instructions (or by email sent to support@DirectSeeds.com) within 48 hours of receipt of goods.

Otherwise, within 48 hours of receipt of goods, the following terms will apply:

DirectSeeds.com deliveries,

The Client must tell the driver immediately. The Client will be charged a re-delivery penalty if (at the discretion of DirectSeeds.com staff) if The Client does not express his/her concern to The Driver before The Driver leaves the premises.

3rd party deliveries (i.e. by The Courier),

The Client must contact DirectSeeds.com immediately by email to request a resolution of the problem. In such cases, DirectSeeds.com may refund the client up to 100% of the price of the goods in question – at the discretion of DirectSeeds.com management. If The Client rejects a refund, DirectSeeds.com may arrange a re-delivery for the next available delivery slot – usually the following working day. However, The Client may incur a reduced re-delivery charge if The Client opts the have the faulty goods re-delivered.

Cancellations

For cancellations before the chosen delivery date:

In the event of a cancellation within 3 days of the delivery date, then a cancellation fee of 100% shall be charged by DirectSeeds.com

For cancellations post dispatch of goods:

If the goods have already be dispatched and The Client decides to cancel the order, thenDirectSeeds.com charge a cancellation fee of 100% of all payments made. Delivery charges are non-refundable.

Product Guarantee

DirectSeeds.com guarantees a quality product and service to you, our customers, if you are not fully satisfied with the service or product received please contact us within 48 hours of receipt of goods, and DirectSeeds.com will investigate all complaints thoroughly. In the event of a genuine complaint DirectSeeds.com will replace the product. This does not effect your statutory rights as a consumer

Seed Care

Keep your seeds in the sealed packet until you are ready to sow, store in a dry, cool place.

If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable. These terms shall be governed by and interpreted in accordance with the laws of England and Wales.

DirectSeeds.com retains the right to change these terms and conditions at any time.
